Terms and Conditions


These Terms and Conditions constitute your binding obligations with Medisattva Solutions Pvt. Ltd (“Medisattva Solutions”). This document is created in accordance with the provisions of Rule 3 of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access.

The “Medisattva” Mobile Application, Application is owned and operated by Medisattva Solutions and Medisattva Solutions in its sole discretion may assign, transfer, and subcontract its rights and/or obligations under these Terms and Conditions to any third party, as it may deem fit, and you shall continue to be bound by these Terms and Conditions in the event of such assignment, transfer, or subcontracting.

Medisattva Solutions reserves the right, at our sole discretion, to change, modify, add, or remove portions of these Terms & conditions, at any time without any prior written notice to You. You shall ensure to review these Terms of conditions periodically for updates/changes. Your continued use of the Platform following the posting of changes will mean that You accept and agree to the revisions. As long as You comply with these Terms & conditions.

Any accessing or browsing of the Platform and using the Services (as defined in these Terms and Conditions) indicates your agreement to all the terms and conditions in this Agreement. If you disagree with any part of the Terms and Conditions, then you may discontinue access or use of the Platform.

Disclaimer

MEDISATTVA SOLUTIONS HAS COME UP WITH AN INITIATIVE TO ENSURE BETTER PATIENT EDUCATION ON THEIR MEDICATIONS, OFFERING CHECKS AND BALANCE WITH THE ULTIMATE GOAL OF REDUCING MEDICAL PRESCRIPTION ERRORS, MAINLY FROM THE CHEMISTS/ MEDICAL STORE. HOWEVER, DESPITE THE ULTIMATE GOAL OF REDUCING PRESCRIPTION ERRORS, THE FINAL AUTHORITY FOR THE SAID PRESCRIPTION SHALL REMAIN WITH THE CONCERNED DOCTOR. THE USERS OF THIS APPLICATION ARE ADVISED TO RECONFIRM THE PRESCRIPTION WITH THEIR PREFERRED DOCTOR PRIOR TO CONSUMING ANY MEDICATION BASED ON THE PRESCRIPTION ISSUED BY ANY CHEMIST / MEDICAL STORE AND RECONFIRMED BY MEDISATTVA SOLUTIONS.

Definitions

a. Medisattva Platform: Any Mobile Application under Medisattva Solutions’ Control, whether partial or otherwise (including, without limitation, Mobile Application, and the Web Portal from which these terms of use were accessed from) and include the Medisattva Solutions Services. The terms “Medisattva Solutions”, “We”, “Us”, “Ours” shall mean Medisattva Solutions Private Limited and its affiliates (“Platform”).

b. Services: The services offered by Medisattva Solutions on their Platform.

c. Medisattva Solutions Services: The Services offered by Medisattva Solutions including creating and maintain user accounts on the Platform, verification of items matching in the prescription, verification of name, dosage, strength & formulation of medication prescribed, accessing your prescription/ medical records on the Platform, and any other service that is made available on the Platform from time to time (“Medisattva Solutions Services”).

d. Users/Patients: The user of the Platform availing services of Medisattva Solutions on regular/emergency basis (“User” / “Patient”).

Privacy Policy

Please review our Privacy Policy, which also governs Your visit/usage of the Platform and to understand our practice. The personal information/data provided by You during the course of usage of the Platform will be treated as strictly confidential and in accordance with the Privacy Policy and applicable laws and regulations. Medisattva Solutions shall be entitled to use the Content, anonymously, or any of its elements for any type of use forever, including but not limited to promotional, analytical, and advertising purposes through any other platform. If You object to Your information being transferred or used, PLEASE DO NOT USE THE PLATFORM IN ANY MANNER WHATSOEVER.

Statement of Services

The Platform is a mobile application that facilitates reading, viewing, accessing prescriptions/medical records, and providing almost accurate direction regarding the medication prescribed by the Doctor. The Platform acts as a venue for educating the Patient and reducing errors in prescription of medication. Medisattva Solutions does not guarantee that the error(s) removed, if any, are true and correct and it is your responsibility to follow-up on the same. Medisattva Solutions takes no position and offers no opinion on when or if the medication prescribed by the Doctor is true and correct for the health issue of the User. In order to provide an optimal platform for reducing medical prescription error, Medisattva Solutions does not involve itself in the consultation between the Doctor and Patient and/or prescription issued by the Doctor pursuant to consultation. Therefore, we cannot ensure complete integrity on behalf of any other Party. The Doctor, and not Medisattva Solutions, is solely responsible for assessing the integrity, honesty, and trustworthiness of all interactions, consultation, prescriptions etc. for which the user communicates on this service.

Eligibility

Upon registering and using the Platform, you represent that you meet the following eligibility criteria:

  • You are at least 18 years old or accessing the Platform under the supervision of a parent or guardian, who in such a case will be deemed as the recipient / end-user of the Medisattva Solution Services for the purpose of these Terms and Conditions.
  • If your age is below that of 18 years, your parents or legal guardians can transact on behalf of you if they are registered users. You are prohibited from accessing the Platform or obtaining services without supervision of an adult.
  • You are legally competent to contract, and otherwise competent to receive the Medisattva Solutions Services. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use the Platform.
  • You have not been previously suspended or removed by Medisattva Solutions or any other group entity or disqualified for any other reason, from availing the Services.
  • Medisattva Solutions reserves the right to terminate your membership and/or refuse to provide you with access to the Platform if Medisattva Solutions discovers that you are under the age of 18 years and transacting without any supervision.

Medisattva Solutions Services

Medisattva Solutions, through its Platform, provides the following services:

  1. Creating and Maintaining User Accounts:
    • Users need to register on the Platform in order to use the Platform or avail themselves of the Services provided through the Platform. In order to register, you have to provide certain personal details including but not limited to your name, phone number, email address, birth date, gender, etc.
  2. Uploading Medical Prescriptions:
    • In order to provide its services, the Users shall have to upload their Medical Prescriptions on to the Platform using the features of the Application.
    • The Users understand that certain permissions would have to be granted to the Application, in order to provide its services seamlessly.
  3. Uploading images / photos of Medicines purchased/procured:
    • In order to avail services, the Users shall have to upload photos/images of the Medicines purchased/procured from the Chemist/Medical store.
  4. Identification of Errors:
    • Upon uploading the Prescription, the Application shall verify the number of items matching the images of the medicines.
    • The Application shall also verify the name, dosage, strength, and formulation of the medication prescribed to the User by their Doctor.
    • The Application shall list the errors, if any, and then it shall be the user’s responsibility to get it re-confirmed with their Doctor.
  5. Videos:
    • User Agreement: By using our app’s video redirection feature, you agree to comply with these terms. You are responsible for the content you access through the app.
    • Usage Restrictions: Users must not engage in activities that violate YouTube’s terms of service. We reserve the right to restrict access to the video redirection feature.
    • Intellectual Property: The content accessed through the video redirection feature is subject to copyright and intellectual property rights. Users must respect the rights of content creators.
    • Liability: We are not liable for the content on YouTube or any issues arising from using the video redirection feature.
    • Termination: We may terminate access to the video redirection feature under certain conditions.
    • Any other service that is made available on the Platform from time to time subject to the scope of services specified hereinunder.

Your Use of the Platform

As an end user of the Platform and recipient of the services, you agree to the following conditions of use:

  1. Due Diligence:
    • You are solely responsible for the medical, health, and personal information you provide on the Platform, and you are requested to use your discretion in providing such information.
    • The services provided on the Platform shall depend on the information provided by you on the Platform. You will provide accurate and complete information everywhere on the Platform, based on which you will receive the Services.
    • You will be solely responsible for all access to and use of this site by anyone using the password and identification originally assigned to you whether or not such access to and use of this site is actually authorized by you, including without limitation, all communications and transmissions and all obligations (including, without limitation, financial obligations) incurred through such access or use. You are solely responsible for protecting the security and confidentiality of the password and identification assigned to you.
    • The information provided by you may be used by us, anonymously, for the purpose of Services including analysis, research, and disclosure (where required) to our affiliates, group companies, agents, and government authorities, etc.
  2. No Liability:
    • The Services availed by you via the Platform can be termed as an extension of the services/consultation provided by your Doctor. The Platform only facilitates re-checking/re-confirming the medical prescription issued by the Doctor and bears no responsibility for the outcome of any such medical consultation or other services obtained by you.
    • Medisattva Solutions shall not be liable for deficiency or shortfall in Services / misdiagnosis / faulty judgement / interpretation error / perception error / adverse events / inefficacy of prescribed treatment or advice or investigation reports / validity of the advice or prescription or investigation reports provided by the Doctor / unavailability of the recommended or medication under any condition or circumstances. Users are advised to use their discretion for following the advice obtained via the Platform.
    • Medisattva Solutions only facilitates the removing of errors and/or correction of dosages, including the name and strength of the medication of the prescription issued by your Doctor and does not in any way facilitate, encourage, permit, or gives you opinion on medical consultation or correction of medication.
    • You may view and access the services available on the Platform solely for the purposes of availing the Services in its intended manner, and only as per these Terms and Conditions. You shall not modify any content on the Platform or reproduce, display, publicly perform, distribute, or otherwise use such content in any way for any public or commercial purpose or for personal gain.

Payments and Refunds

Currently, the Platform being in its development stage, the services offered on the Platform are provided free of charge. However, Medisattva Solutions, in its sole discretion, at any later point in time, may introduce paid/subscription-based services. Upon introduction of such paid services, you will be bound by such terms and condition mentioned herein and the same shall remain in force in the event Medisattva Solutions decides to assign, transfer, and subcontract its rights and/or obligations. Acceptance of this terms and conditions will be deemed to be a sufficient notice to you or to anyone who agrees to use the aforesaid Platform. For any payment and refund, it shall be the responsibility of the User to enter correct banking information. Medisattva Solutions does not play any role with regards to entering banking information.

  1. Payments:
    • You may use any payment service, like UPI, internet banking or debit or credit cards for making payments for loading/recharging the Wallet on the Platform. You shall be directed to our third-party payment gateway partners such as PayU, Paytm, PhonePe, CRED Pay, Juspay, Amazon Pay once you proceed to load/recharge the Wallet. Once re-directed to the Payment Gateway, you agree to be bound by the terms and conditions and privacy policy prescribed by the third-party payment gateway, basis which, the transaction shall take place. We will share your details with the Payment Gateway and the same shall be processed in accordance with the respective Payment Gateway’s privacy policy as may be made available to you by such Payment Gateway. For removal of doubts, it is clarified that, we neither directly nor indirectly charge any amount for Tokenisation services. Any update in pricing of the Services over the Platform shall not be deemed to be construed any charge for tokenisation services.
    • Medisattva Solutions shall not be liable in any manner whatsoever, if incorrect or inaccurate details (including those concerning credit or debit card(s)) are provided by you or if you use a credit or debit card which is not lawfully owned by you or if you permit a third party to use your password or any other means of accessing your bank account or credit card or debit card. Please note that neither we nor the Payment Gateway will be monitoring your use of any payment channel and you are required to use the payment modes at your sole option and risks.
    • The Payment Gateway may block any card number, account numbers, group of cards or transactions from any specific blocked or blacklisted customer cards, accounts, group of IP addresses, devices, geographic locations as deemed fit.
    • The Payment Gateway and banks reserve their right to reject payments with respect for any transaction including for suspicious and unlawful transactions, potential or actual fraud, suspicious activities, card authentication and authorization issues, over payment made due to mathematical errors or any other issue.
    • Solutions provides a mere platform to rectify errors, if any made by Chemist/ Medical Store while supplying/ selling medication based on the prescription, enabling you to gain knowledge of actual needed medications through the Platform. Medisattva Solutions shall not be liable in any circumstances for any failed payment occurring due to any reason. In the event of any failed payment, it shall be your duty to take the case with your banking partner. Medisattva Solutions does not participate and shall not be held liable for any activity between you and the Payment Gateway, including but not limited to failure of payment, payment not reflected in the Wallet, etc.
  2. Refunds:
    • Refunds for all eligible cancellations are issued through the payment method used at the time of payment.
    • You will not receive cash refunds in connection with a card sale. The refund amount, subject to Medisattva Solutions Cancellation Fees and Payment gateway Fees, shall be reflected on the Platform.
    • Refunds shall not be processed to third-party accounts. The user initiating refund shall get the refund amount added back in his/ her App Account wallet.
    • Refunds will only be made against genuine and trackable cancellation requests generated by you by clicking on the cancellation button provided on the Platform. Refund request against delays, dissenting opinion of your Doctor, re-proofing of Prescription etc. will not be entertained. In such situation, Medisattva Solutions shall not be held liable for such deficiency of service and no refund shall be provided in such events.
  3. Refund Timeline:
    • The refund initiated by the user shall be processed in 15 working days subject to Payment gateway/bank’s timelines. All communications with regards to refund should be sent to Any and all refunds, if approved by the Payment Gateway/Bank, shall reflect in your bank account/card used to complete the transaction. It shall be your duty to ensure the refund and contact Payment Gateway/Bank in case of any discrepancy.
    • Any money refunded shall be your and your banking partner’s responsibility. Medisattva Solutions shall not be held liable for any failure of transaction, non-reflection of amount, any other error etc. related to the said transaction.
    • Medisattva Solutions shall not be held liable for any refunds, if not approved by the Payment gateway and/or Bank. It shall be the sole responsibility of the user to approach appropriate authority regarding any discrepancy in transaction/reflection of amount.

Prohibited Content

The user shall not upload to, distribute, or otherwise to the Platform, the following Prohibited Content, which includes any content, information, or other material that:

  1. Belongs to another person and which you do not own the rights;

  2. Is harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, invasive of another’s privacy, including bodily privacy, insulting, or harassing on the basis of gender, libellous, racially, or ethnically objectionable, or otherwise inconsistent with or contrary to the laws in force;

  3. Is hateful, racially, or ethnically objectionable, disparaging of any person;

  4. Relates to or seems to encourage money laundering or gambling;

  5. Harm minors in any way;

  6. Infringes any patent, trademark, copyright, or other proprietary rights;

  7. Deceives or misleads the addressee about the origin of your message and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact;

  8. Communicate any information which is grossly offensive or menacing in nature;

  9. Impersonate another person;

  10. Contains software viruses and malicious programs;

  11. Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order;

  12. Is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity, or agency for financial gain or to cause any injury to any person;

  13. Incites any offence or prevents investigation of any offence or insults any other nation;

  14. Is abusive or inappropriate to the conducting in your medical consultation or any employees, consultants, or technicians or any other affiliate who you may interacted with for availing Services; and

  15. Is not relating to the services you avail form us.

You also understand and acknowledge that if you fail to adhere to the above, we have the right to remove such information and / or immediately terminate your access to the Services and / or to the Platform.

Limited Liability

By enrolling with Medisattva Solutions and its Platform, you understand and agree to the following:

  1. The Services availed by you via the Platform are provided on the basis of knowledge and expertise of the person. The limitation of liability specified in this section also applies to any service availed by you if in case it is not possible for our personnel to check if the prescription is not printed, or the prescription is not written in legible handwriting.

  2. The Platform on facilitates the correction of wrong medication in terms of name, dosage, strength and formulation as issued by your Doctor and as such, Medisattva Solutions bears no responsibility for the quality and outcome of any such Services availed by you, to the extent permitted by applicable law.

  3. Medisattva Solutions itself does not provide any medical consultation or diagnostic services. If you receive any incorrect prescription as against any advice/ medical opinion/ medical report from a Doctor you have contacted, you are responsible for assessing such opinions and reports, prior to availing our services. The consequences of acting on such updated prescriptions, shall be your sole responsibility.

  4. To the extent permitted by applicable law, Medisattva Solutions or its affiliates or any group companies will not be liable to you for any special, indirect, incidental, consequential, punitive, reliance, or exemplary damages arising out of or relating to:

    • These terms and conditions and privacy policy; and

    • Your use or inability to use the platform.

Indemnity

You agree and undertake to indemnify and keep indemnified Medisattva Solutions, its affiliates, any group companies and the concerned employee, agent, etc. (“Indemnified Persons”) for any losses, costs, charges, and expenses including reasonable attorney fees that the concerned Indemnified Persons may suffer on account of:

  1. Deficiency or shortfall in Services / faulty judgment / interpretation errors / perception error arising from:

    • Your failure to provide correct and / or complete clinical information / history on the Platform in a timely and clinically appropriate manner;
    • Suppression of material facts; or your failure to provide relevant clinical information about the patient; or

  2. Misrepresentation of the advice / prescription report by you.

  3. Incorrect or inaccurate credit / debit card details provided by you.

  4. Using a credit / debit card which is not lawfully owned by you; or

  5. permitting a third party to use your password or other means to access your account.

Intellectual Property Rights

All trademarks, copyright, patent, and/or other proprietary rights and Laws and service marks with respect to the services are owned by Medisattva Solutions. The trade names, trademarks, and service marks owned by Medisattva Solutions, whether registered or unregistered, may not be used in connection with any Service that doesn’t belong to any third-Party, in any manner that is likely to cause confusion. Nothing contained on the Platform should be construed as granting, by implication, estoppels or otherwise, any license or right to use Medisattva Solutions’ trade names, trademarks, or service marks without the express prior written consent of Medisattva Solutions.

Confidentiality

The user shall not share any information of Medisattva Solutions, or the services availed from Medisattva Solutions from the Platform, without the prior written approval of Medisattva Solutions. The user shall exercise reasonable care to protect the Confidential Information of Medisattva and other users from unauthorized disclosure, which care will in no event be less than the user takes to protect its own Confidential Information of a like nature. The user may disclose Confidential Information only to its family members or related persons who need to know such information for purposes of these terms and conditions, and will inform such related parties, by way of Policy and terms & conditions, that they are bound by obligations of Confidentiality. The user’s duty to hold Confidential Information in confidence shall be perpetual.

Indemnification

The user agrees to indemnify and hold Medisattva Solutions, its officers, directors, agents, and employees, harmless from any claim or demand, losses, cause of action, damage, Lawsuits including reasonable Attorney’s fees and costs, arising out of, or relating to the services availed under these terms & conditions. The user agrees to defend any and all claims, demands, and cause of action, lawsuits and / or judgments arising out of, or relating to the Services availed under these terms & conditions, unless expressly stated otherwise by Medisattva Solutions in writing.

Relationship Between the Parties

The user is acting in its independent capacity; and nothing in these Terms & Conditions will be construed to create a Partnership, Joint Venture, or Agency relationship between the Parties. Each Party will be solely responsible for payment of all compensation owed to its employees, as well as employment related taxes.

Charges & Payments

The total Price for availing the desired service under these terms & conditions shall be payable in Indian Rupee only. Medisattva Solutions will release the payment as per its policy through its payment platform. The user shall individually be liable for payment of its own applicable Taxes; filing of Returns and necessary payments, if any. The user neither will hold the other liable for payment of the applicable dues of the other.

Force Majure

Any event beyond the reasonable control of the Parties, and which is unavoidable notwithstanding the reasonable care of the party affected, and shall include but not limited to war, insurrection, riot, civil unrest, sabotage, boycott, embargo, explosion, fire, earthquake, flood, unavoidable accident, epidemic, act of God, action or inaction of any governmental official or agency (civil or military) and refusal of any licenses or permits, if properly applied for. If either Party is prevented from or delayed in performing any of its obligations under these terms’ conditions by an event of Force Majeure, then it shall notify the other in writing of the occurrence of such event and the circumstances thereof within Fifteen (15) days after the occurrence of such event. The Party who has given such notice shall be excused from the performance or punctual performance of its obligations as per these terms & conditions for so long as the relevant event of Force Majeure continues and to the extent that such Party’s performance is prevented or delayed. The occurrence of any event of Force Majeure affecting either party shall not give rise to any claim for damages or additional costs and expenses suffered or incurred by reason of Force Majeure.

Jurisdiction

Any dispute, controversy or claims arising out of or relating to these terms & conditions or the breach, termination, or invalidity thereof, shall be settled by arbitration in accordance with the provisions of the [Indian] Arbitration and Conciliation Act, 1996. The Arbitral Tribunal shall be composed of one Arbitrator appointed by the Company. The place of Arbitration shall be at Ahmedabad, Gujarat. The Arbitral proceedings shall be conducted in English language and the Award shall be rendered in English only. The procedural Law of the Arbitration shall be Indian Law. The Award of the Arbitral Tribunal shall be final, conclusive, and binding upon the Parties, and the provisions of the Arbitration and Conciliation Act, 1996 shall apply. The rights and obligations of the Parties under, or pursuant to, this Clause, including the Arbitration Agreement in this Clause, shall be governed by and be subject to Indian Law, and shall be subject to the exclusive Jurisdiction of the Courts at Ahmedabad, Gujarat.

Amendments to the Terms & Conditions

Medisattva Solutions reserves the right to make changes to the policies, and these terms & conditions at any time. The user registered on the Platform will be subject to the policies and terms & conditions in force at the time unless any change to those policies or these conditions is required to be made by Law or Government authority. If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

Waiver

Neither party shall be deemed by mere lapse of time (without giving notice or taking other action hereunder) to have waived any breach by the other party of any of the provisions of these terms & conditions. Further, the waiver by either party of a particular breach of these terms & conditions by the other party shall not be construed as, or constitute, a continuing waiver of such breach, or of other breaches of the same or other provisions of this terms & conditions. If you breach these conditions and we take no action; we will still be entitled to use our rights and remedies in any other situation where You breach these conditions.

DISCLAIMER

THE SERVICES DISPLAYED ON THE PLATFORM CONTAIN CERTAIN TRADE- MARKS, LOGOS OR SERVICE MARKS (“MARKS”) WHICH ARE OWNED BY THE RESPECTIVE BRAND OWNERS/SUPPLIERS OR ITS APPLICABLE ASSIGNORS AND MEDISATTVA SOLUTIONS DOES NOT HAVE ANY OWNERSHIP OR CLAIM OVER THE SAID MARKS OR FOR THAT MATTER ANY OTHER FORM OF INTELLECTUAL PROPERTY. ALL TEXT, DESIGN AND OTHER WORKS ON THE PLATFORM THAT ARE NOT OWNED BY THE BRAND OWNERS/SUPPLIERS OR ITS APPLICABLE ASSIGNORS ARE THE COPYRIGHTED WORKS OF MEDISATTVA SOLUTIONS OR ITS LICENSORS. MEDISATTVA SOLUTIONS MAY DISPLAY THE CONTENTS/FEATURES OF THE SERVICES LISTED ON THE PLATFORM AS WELL AS TO USE THE TRADEMARKS, SERVICE MARKS AND LOGOS (“MARKS”) OWNED BY THE RESPECTIVE BRAND OWNERS OR OTHER PARTIES ON THE PLATFORM, (SUBJECT TO COPYRIGHT AND OTHER INTELLECTUAL PROPERTY RIGHTS UNDER THE LAW) FOR THE PURPOSE OF INFORMATION AND THE BRAND OWNER OR ITS LICENSORS SHALL NOT CLAIM ANY ACTION FOR WRONGFUL USE AGAINST MEDISATTVA SOLUTIONS FOR THE SAID USE. MEDISATTVA SOLUTIONS SPECIFICALLY DISCLAIMS OWNERSHIP OVER THE FEATURES OF THE SERVICES LISTED ON THE PLATFORM. THE OWNERSHIP OF EACH SUCH FEATURE/SERVICES AS WELL THE ASSOCIATED INTELLECTUAL PROPERTY BELONGS TO RESPECTIVE BRAND OWNER ONLY. MEDISATTVA SOLUTIONS HAS GOT DEVELOPED FOR ITSELF A UNIQUE PLATFORM RELATED TO PROVIDING OF SERVICES IN CONNECTION WITH HEALTH INDUSTRY. HOWEVER, IN CASE YOU ARE THE OWNER OF ANY FORM OF INTELLECTUAL PROPERTY WHICH IS USED ON THE PLATFORM AND DO NOT WANT MEDISATTVA SOLUTIONS TO CONTINUE USING THE SAID INTELLECTUAL PROPERTY, YOU ARE REQUESTED TO INTIMATE MEDISATTVA SOLUTIONS IN WRITING ALONG WITH NECESSARY DOCUMENTARY EVIDENCE SUPPORTING YOUR CLAIM OF OWNERSHIP OVER THE SAID INTELLECTUAL PROPERTY. YOU ARE AGREEING TO THE CLAUSES OF THESE TERMS AND CONDITIONS IN GOOD FAITH AND SHALL PERFORM ITS RESPONSIBILITIES WITHOUT ANY MALA FIDE INTENTION. THE USER SHALL ENSURE THAT IT OWNS THE TITLE, RIGHTS AND INTERESTS FOR THE SERVICES BEING OFFERED BY HIM/HER ON THE PLATFORM. MEDISATTVA SOLUTIONS SHALL NOT BE RESPONSIBLE FOR ANY NON-PERFORMANCE AND/OR BREACH OF ANY CONTRACT AND/OR NON- COMPLIANCE WITH ANY AND ALL APPLICABLE LAWS, ORDINANCES, RULES, GOVERNMENT GUIDELINES AND DIRECTIVES ON PART OF THE USER.
